§ 1. General Provisions
1.1. The online store adrapaintings.com, available at https://adrapaintings.com (hereinafter “the Store”), is operated by [Lorem Ipsum Sp. z o.o., ul. Lorem Ipsum 00, 00-000 Warszawa, NIP: 0000000000].
1.2. These Terms of Service govern the rules for placing orders and purchasing Products through the Store.

1.4. Definitions:
Customer – Any person making purchases in the Store
Consumer – A Customer who is a natural person making purchases not directly related to their business or professional activity
Product – Canvas prints, paper prints, and original artworks available in the Store
Print Products – Canvas and paper prints produced on-demand via our fulfillment partner
Original Artworks – Unique, one-of-a-kind paintings shipped from Warsaw, Poland
Sales Agreement – A contract for the sale of a Product between the Customer and the Store
§ 2. Placing Orders
2.1. Orders can be placed 24/7 through the Store’s website.
2.2. To place an order:
Select a Product and add it to cart
Proceed to checkout
Provide required information: name, delivery address, email, phone number
Select payment method
Confirm the order by clicking “Buy and pay”
2.3. Placing an order constitutes an offer to conclude a Sales Agreement.
2.4. Upon placing an order, the Customer receives automatic confirmation via email. The Sales Agreement is concluded when the Customer receives email confirmation that the order has been accepted for processing.
§ 3. Prices and Payment
3.1. All prices are gross prices in Euro (€).
3.2. Shipping costs are calculated at checkout and clearly displayed before order confirmation.
3.3. The Store reserves the right to change prices, introduce new Products, and modify promotional campaigns. Changes do not affect orders placed before they take effect.
3.4. Payment methods:
Payment via payment operator (Stripe, PayPal)
Bank transfer to the Store’s account
3.5. Payment must be made within 3 business days from the Sales Agreement conclusion.
§ 4. Order Fulfillment and Delivery
4.1. Print Products (Canvas & Paper Prints)
4.1.1. Print Products are produced on-demand by our fulfillment partner Printumo.
4.1.2. Production time: 2-3 business days after payment confirmation.
4.1.3. Production facilities are located globally, including the EU, UK, and internationally. Orders are automatically routed to the closest available facility to optimize delivery times and costs.
4.1.4. Shipping: Courier services (DPD, FedEx, DHL).
4.1.5. Estimated delivery time varies by destination:
EU: 3-7 business days after production
UK: 3-7 business days after production
USA/Canada/Australia: 5-10 business days after production
4.2. Original Artworks
4.2.1. Original Artworks are shipped from Warsaw, Poland.
4.2.2. Preparation time: 2-5 business days after payment confirmation.
4.2.3. Shipping: Courier services (DHL, FedEx, DPD).
4.2.4. Delivery times vary by destination.
4.3. General Delivery Information
4.3.1. Delivery times are estimates and may be affected by factors beyond the Store’s control.
4.3.2. For international shipments outside the EU, customs duties and import taxes may apply. These charges are the Customer’s responsibility.
4.3.3. The Store ensures proper and secure packaging to minimize transit damage risk. Customers should inspect shipments in the courier’s presence.
§ 5. Right of Withdrawal
5.1. Print Products (Canvas & Paper Prints)
5.1.1. Print Products are produced specifically for each order based on the Customer’s selection and constitute personalized goods under Article 38(3) of the Consumer Rights Directive (2011/83/EU).
5.1.2. The right of withdrawal does NOT apply to Print Products, as they are made to the Customer’s specifications.
5.1.3. This exclusion applies to all Customers, including Consumers.
5.2. Original Artworks
5.2.1. Consumers have the right to withdraw from the Sales Agreement for Original Artworks without giving reason within 14 days from receiving the Product.
5.2.2. To exercise this right, the Consumer must send an unequivocal statement to: support@adrapaintings.com
5.2.3. The Consumer must return the Product immediately, no later than 14 days from communicating withdrawal.
5.2.4. Return shipping costs are borne by the Consumer.
5.2.5. The Product must be returned undamaged, in original or equally protective packaging.
5.2.6. The Store will refund all payments received (including standard delivery costs) within 14 days of being informed of withdrawal, provided the Product is received and inspected.
5.2.7. Damaged Products will not be accepted for return.
§ 6. Complaints and Warranty
6.1. Print Products
6.1.1. Customers must report damaged or defective Print Products within 48 hours of delivery to: support@adrapaintings.com
6.1.2. The complaint must include:
Order number
Description of the defect
Photographic documentation of the damaged item and packaging
6.1.3. Original packaging should be retained for potential insurance claims.
6.1.4. Valid complaints will result in a replacement at no additional cost to the Customer.
6.2. Original Artworks
6.2.1. Complaints for Original Artworks must be submitted within 14 days of delivery to: support@adrapaintings.com
6.2.2. The complaint should include defect description and photographic documentation.
6.2.3. The Store will process complaints within 14 days of receipt.
§ 7. Copyright and Intellectual Property
7.1. All Products are original works of art or reproductions thereof, subject to copyright law.
7.2. The Sales Agreement does not transfer copyright to the Product.
7.3. The Customer acquires only ownership of the physical item.
7.4. The Customer may not copy, reproduce, publicly display, or use the Product for commercial purposes without prior written consent.
§ 8. Personal Data Protection
8.1. The Store is the data controller for Customer personal data.
8.2. Personal data is processed to fulfill orders and, with consent, for marketing purposes.
8.3. Detailed information is available in the Privacy Policy on the Store’s website.
§ 9. Final Provisions
9.1. Matters not covered by these Terms are governed by applicable law.
9.2. The Store reserves the right to amend these Terms. Changes take effect on the date specified by the Store, not less than 7 days after publication.
9.3. Disputes arising from Sales Agreements shall be resolved by competent courts.
9.4. Consumers may use out-of-court complaint and redress procedures, including the EU ODR platform: http://ec.europa.eu/consumers/odr/
